Word similarity

Fovea IP’s watching service is unique and innovative.

This gives the IP professional a competitive advantage when analyzing, transmitting, and administering watching, all whilst offering a quality and accuracy superior to what is currently available.

“Word similarity” watching is performed daily and identifies all marks that

  • are identical or similar in the searched Nice classes, or
  • are phonetically identical in any other class

where it could be reasonable for you to oppose the application/registration.

Word screening

Word screening watching allows the client to identify, at a lower cost, the new applications that are very close to the watched mark.

These watches are limited to marks that

  • are identical, alphabetically or phonetically, or
  • contain one additional, deleted or replaced letter or,
  • contain, for slogans only, at least two phonetically identical words.

Phonetically identicals

This type of watching service identifies the identical marks, alphabetically or phonetically in the watched classes and their related classes.

Figurative similarity

For these watches, Fovea IP uses proprietary artificial intelligence technology which is similar to facial or fingerprint recognition applications.

This technology is more reliable than the previous systems that use Vienna classes.

Owners

This type of watching is mainly used for:

  • portfolio audits, or
  • to identify the markets where a competitor plans to develop its operations and/or market share.

“Owner” watching is trustworthy and available worldwide.

However, these watches depend on several factors that Fovea IP does not control, such as:

  • Has the owner’s name been correctly spelled by the relevant Trademark Office?
  • Has the transliteration been done correctly? Fovea IP uses tools that (partially) compensates for this problem.

Company names

These watches are performed on a global database that Fovea IP accesses but does not own.

Domain names

The Fovea IP database comprises over 300 000 000 domain names, including:

  • All .COM, .EU and national extensions.
  • Over 1,200 ‘generic Top-Level Domains’.
  • Over 300 ‘country code Top-Level Domains’.
  • The new ccTLDs and gTLDs are added as soon as available.
  • All above domains are constantly updated.

We cannot guarantee the comprehensiveness of our domain names database but believe it to be, globally, the most complete and accurate.

Fovea IP’s watching service informs you of any new domain name that is identical or very similar to the name being watched.

Portfolio watching

The “portfolio” watching service watches, almost automatically and during the whole lifespan of each registration, each of the owner’s trademarks in the countries where the trademark is being protected.

Portfolio watches are adapted for each client’s needs.  This explains why Fovea IP publishes no price guide.

The Prior Rights Search

The ‘Prior Rights’ Search provides any potential Opposer with all the Information (s)he needs regarding the rights that the potential Defender owns that which (s)he could use for a counterattack against any rights owned by the potential Opposer.

If such rights exist, the Prior Rights Search warns the potential Opposer about the existence of these rights that could ‘boomerang’ against one or more potential Opposer’s rights.
This search is made available on the Fovea IP’s platform

  • immediately and at no charge for our watch clients and,
  • at a charge and within minutes, for others.

The Prior Rights Search reports all existing applications/registrations filed or registered by the (potential) Defender:

  1. in the (potential) Defender’s home country, or
  2. in the opposition jurisdiction, plus
  3. worldwide, for any mark that is identical to the mark to be opposed.

This search is limited to

  • the class(es) that are common to the potential Opposer’s and the potential Defender’s marks, or
  • should there be no common class, to any class selected by the potential Opposer.
