Our database includes the ‘Pharma in use database’ compiled and made available by IQVIA World Publications Limited. It is updated twice a year. This database covers the countries listed in the attachment (to view the Pharma in Use database click here). When a search covers class 5, INNs are searched automatically. Please specify when a search should be conducted in the “Pharmaceuticals in use” database. A surcharge of 50%, will be added.
An in use search identifies a serious usage/lack of usage of a trademark for a given product or service.
Our Investigation services - which we farm out to a specialized firm - include:
An executive summary on the trademark usage;
Open-source research (OSINT – Open Source Intelligence);
Company records and information;
Website and domain analysis;
Professional and social media check;
Internet search term trends;
Media and advertising databases;
Discrete phone and/or email contact with the mark holder and/or affiliates.
For trademarks, we use the INTERNATIONAL ‘Nice’ classification system. Those few marks that are not classified are always reported independently of the class selection when they meet the other searching criteria.
When performing a clearance or a knockout search we will also automatically report all identical marks and most phonetically identical marks in the related classes.
