Opposition deadlines

  • All new applications are monitored in our watching service and - when needed - reported in virtually all cases well before the expiration of the opposition deadline period.

Algorithm

  • Our extended similarity algorithm is applied for wordmarks and/or figurative marks both for watches and searches.
  • In addition, for wordmark searching we can limit our investigations to knock-out or phonetically identical searches. This drastically decreases the cost and the length of the reports.
  • Marks that have no classification and relevant are always reported.

Algorithm

  • Our AI Industrial Designs similarity algorithm is a revolutionary search powered by AI (Artificial intelligence). The technology bears resemblances with human fingerprints or face recognition. It retrieves most similar records based on image recognition.

Since it is independent of the error-prone Locarno classification it substantially increases reliability at unforeseen speed and unbeatable cost.

Databases/ Company Names

For most company name searches/watches we use The Moody’s database.

Databases/ Common Law

For common law searches we use the Lexis/Nexis platform
We do not offer online Common Law searches

Databases/ Pharma in use

Our database includes the ‘Pharma in use database’ compiled and made available by IQVIA World Publications Limited. It is updated twice a year. This database covers the countries listed in the attachment (to view the Pharma in Use database click here). When a search covers class 5, INNs are searched automatically. Please specify when a search should be conducted in the “Pharmaceuticals in use” database. A surcharge of 50%, will be added.

In Use searches

An in use search identifies a serious usage/lack of usage of a trademark for a given product or service.
Our Investigation services - which we farm out to a specialized firm - include:
An executive summary on the trademark usage;
Open-source research (OSINT – Open Source Intelligence);
Company records and information;
Website and domain analysis;
Professional and social media check;
Internet search term trends;
Media and advertising databases;
Discrete phone and/or email contact with the mark holder and/or affiliates.

Class Information

For trademarks, we use the INTERNATIONAL ‘Nice’ classification system. Those few marks that are not classified are always reported independently of the class selection when they meet the other searching criteria.
When performing a clearance or a knockout search we will also automatically report all identical marks and most phonetically identical marks in the related classes.
