My Ordered Searches

Mission

Users can order offline searches from the Fovea IP team. Our analysts will run these searches for the users and deliver a search report which will be sent by email to the user(s) and will be available on their Fovea IP account for review.

Ordered searches can be reviewed on the Fovea IP platform with all the analysis and reporting functionalities available. The reports can be downloaded from the platform, can be shared across users and can also be shared externally with outside counsels, for example.

Mission

Fovea IP offers watching services across trademarks, company names, domain names and owner names. The watch reports are delivered to the users by email, and are also available on the Fovea IP platform in the Ordered Watches section.

The purpose of Fovea IP’s trademark watch service is to identify new trademark publications that are identical or similar to the trademark watched. Also, whenever a new watch is activated, we inform you of any past identical/similar publication for which the opposition deadline is still ongoing.

Multicriteria

Mission

Multicriteria is a module designed to manually search across the selected databases. There is no underlying automation or artificial intelligence, the users defines the search strategy to be applied.
The Multicriteria search module allows the user to search across more than 40 criteria: owner, representative, number, date, type of mark, etc.

  • Identical searches
  • Custom searches with wildcards and Boolean operators

Important:

A search on Trademark Name ROCK will allow you to retrieve trademarks ROCK or containing ROCK as a standalone word, such as ROCK THIS PARTY. It will not allow you to retrieve ROCKS or ROCKY or ROCKABILLY.

Word Similarity

Mission

This module allows users to run word mark searches with the help of an automated search strategy which is accessible to the user and editable by the user. Wildcard characters are not supported in this module.

This module is solely dedicated to availability searching. Other types of searches (owner, numbers, dates, etc) are not supported and have to be run through the Multicriteria module.

The Word Similarity module includes 3 levels of strategy: identical phonetic, extended and similarity.

The system will adapt the search strategy based on the selected level of similarity chosen by the user, and also based on the nature of the trademark searched: number of letters, number of words, invented or existing word.

IA Figurative

Mission

This module allows user to run a Figurative search on trademark databases using our proprietary Image-recognition Technology. This search doesn’t allow for any Vienna codes. The search will be purely based on the image (and classes/registers).

The search will be run independently from colors.

IA Industrial designs

Mission

This module allows users to run an Industrial Design search using our proprietary Image-recognition technology. This technology facilitates the pre-selection of relevant results among registered designs.

The search will be run across active and inactive registered designs.

Extremely important: the Image technology can be very sensitive especially for designs (3D). Therefore, it is critical to use images of the best possible quality, with a good contrast and no disruptive elements around the object to be searched.

User should preferably use drawing(s) and photograph(s).

User can upload several views of the same object (up to 7 views). These views should have an added value to the search.

This alert allows you to set up a monitoring on search results.
The system allows you to be informed, at the frequency of your choice (weekly, monthly etc) of any new search results matching your search criteria.
Ex: competition watch: launch a search on an owner and set up an alert to be informed of any new entry in our database by this owner.
Ex: product watch: launch a search on a specific product and set up an alert to be informed of any new entry in our database for this product.

The “Hit count” allows you to see how many results you get for each jurisdictions searched. We also display a hit count based on the Regions when, for example, you perform a Worldwide search.

Mission

The Folders allow users to save their searches in specific files/sub-files and therefore create their own tree structure of saved searches and records.

The Multicriteria search module allows the user to perform:

  • Identical searches
  • Custom searches with wildcards and Boolean operators
  • Searches across more than 40 criteria: owner, representative, number, date, type of mark, etc.

Once you have logged in to the platform and you have selected the most suitable module, you can directly select the registers on which you want to perform the search.

REGISTERS

Select the needed databases and then the registers/group of registers by ticking the corresponding boxes.

On the bottom right side of the screen, you can easily see the data coverage by countries.
Don’t hesitate to create group of often used registers if necessary. This will allow you to quickly access to the desired registers.

Select the registers. Click on the bottom of the page on “group of registers” and then on “Save selection”. Give a name to the group and click on “OK”.

By selecting a national country that is part of the Madrid Agreement and Protocol, the system will automatically select the EUIPO/WIPO when applicable.
If you don’t need to limit the results for the WIPO register designating the selected countries, please unselect the WIPO (limited to designated countries) box.

Trademarks and Pharmaceutical Databases, identified with this symbol , can be searched together in a single request. Select the Trademark databases, then click on the Pharmaceutical option and select the databases. Click on OK to validate.

HOW TO SET UP YOUR SEARCH CRITERIA?

There is more than 40 different criteria available by clicking on the 1st criteria dropdown menu.

 

 


Using the “Trade Mark Name” criteria allows you to enter some wildcard characters for custom searching.
There are 6 wildcard characters:  ?, *, =, _, ^, ~

The wildcard: ?

To perform a single character wildcard search, use the question mark  ?  symbol. It replaces 1 single character or a null character. The single character wildcard search looks for terms that match hits with the single character replaced.
For example, to search for  TEXT,  TET  or   TEST, you can use the search:  TE?T

The wildcard: *

To perform a multiple character wildcard search, use the asterisk  symbol. It replaces zero or unlimited characters. Multiple character wildcard searches look for 0 or more characters.
For example, to search for  WINDOWS or   WIN95, you can use the search:  WIN*
You can also use the wildcard searches in the middle of a term. For example, to search for  WIN95  or   WINDOWS95, you can use the search:  WI*95

The wildcard:  =

To perform a single digit wildcard search, use the symbol  =. It replaces strictly 1 single digit (not an empty digit). The single character wildcard search looks for terms that match hits with the single digit replaced.
For example, to search for  TE2T or   TE3T, you can use the search:  TE=T

The wildcard: _

To perform a single vowel wildcard search, use the underscore  symbol. It replaces strictly 1 single vowel (not an empty vowel). The single character wildcard search looks for terms that match hits with the single vowel replaced.
For example, to search for  TET  or  TAT, you can use the search:  T_T

The wildcard: ^

To perform a single consonant wildcard search, use the caret   symbol. It replaces strictly 1 single consonant (not an empty consonant). The single character wildcard search looks for terms that match hits with the single consonant replaced.
For example, to search for  TRT  or  TBT, you can use the search:  T ^T

The wildcard: ~

Proximity Searches

Proximity searches allow you to find words that are within a specific distance from each other. To perform a proximity search, use the tilde (“~“) symbol at the end of a phrase. To search for the words “DRIVEN” and “MOTOR” within 5 words of each other, use the following search instruction:  “DRIVEN MOTOR”~5

BOOLEAN OPERATORS

There are 3 Boolean operators based on the navigation language and can be used on each text or number field.
Using the English interface:  AND, OR, NOT
Using the French interface:   ET, OU, PAS
Using the German interface:  UND, ODER, NICHT
Using the Spanish interface:  Y, O, NO
Using the Italian interface:  E, O, NON
Using the Japanese interface:  AND, OR, NOT
Using the Chinese interface:  与, 或,

The Boolean operator: OR

  • The  OR operator is the default conjunction operator for none text searching fields such: Numbers, Type, Status. The  OR  operator links two terms, and finds a matching hit if either of the terms exist.
  • For Brand, Owners, Goods & Services, Representative, the default operator between two terms is   AND. This means that if there is no Boolean operator between two text searched terms, the  AND  operator is used.
  • To search for hits that contain either  JURASIC  or  CONFLUENCE  (without using quotes), use the query:  JURASIC  OR  CONFLUENCE


The Boolean operator: AND

  • The  AND operator matches hits where both terms exist anywhere in the searched term of a single hit. This is equivalent to an intersection using sets.
  • To search for hits that contain  JURASIC  and  CONFLUENCE, use the query:  JURASIC  AND  CONFLUENCE
  • To search for hits that contain  JURASIC and  CONFLUENCE directly after each other, use the query:   “JURASIC  CONFLUENCE” (with quotes).
  • Please note that for  “JURASIC CONFLUENCE”, the system will not find  CONFLUENCE  JURASIC and also will not found  CONFLUENCE  FOR  JURASIC  (words need to be directly after each other).


The Boolean operator: NOT

  • The  NOT operator excludes hits that contain the term after  NOT
  • To search for hits that contain  JURASIC but not  CONFLUENCE, use the query:  JURASIC  NOT  CONFLUENCE


Grouping queries: ( )

You can also use parenthesis  ( ) to group elements to form sub queries. This can be very useful if you want to control the Boolean logic for a query. To search for either  JAKARTA  or  APACHE  and  WEBSITE, use the query:  (JAKARTA  OR  APACHE)  AND  WEBSITE This eliminates any confusion and makes sure you that WEBSITE must exist and either term JAKARTA or APACHE may exist.
