My Ordered Searches

Mission

Users can order offline searches from the Fovea IP team. Our analysts will run these searches for the users and deliver a search report which will be sent by email to the user(s) and will be available on their Fovea IP account for review.

Ordered searches can be reviewed on the Fovea IP platform with all the analysis and reporting functionalities available. The reports can be downloaded from the platform, can be shared across users and can also be shared externally with outside counsels, for example.

Mission

Fovea IP offers watching services across trademarks, company names, domain names and owner names. The watch reports are delivered to the users by email, and are also available on the Fovea IP platform in the Ordered Watches section.

The purpose of Fovea IP’s trademark watch service is to identify new trademark publications that are identical or similar to the trademark watched. Also, whenever a new watch is activated, we inform you of any past identical/similar publication for which the opposition deadline is still ongoing.

Multicriteria

Mission

Multicriteria is a module designed to manually search across the selected databases. There is no underlying automation or artificial intelligence, the users defines the search strategy to be applied.
The Multicriteria search module allows the user to search across more than 40 criteria: owner, representative, number, date, type of mark, etc.

  • Identical searches
  • Custom searches with wildcards and Boolean operators

Important:

A search on Trademark Name ROCK will allow you to retrieve trademarks ROCK or containing ROCK as a standalone word, such as ROCK THIS PARTY. It will not allow you to retrieve ROCKS or ROCKY or ROCKABILLY.

Word Similarity

Mission

This module allows users to run word mark searches with the help of an automated search strategy which is accessible to the user and editable by the user. Wildcard characters are not supported in this module.

This module is solely dedicated to availability searching. Other types of searches (owner, numbers, dates, etc) are not supported and have to be run through the Multicriteria module.

The Word Similarity module includes 3 levels of strategy: identical phonetic, extended and similarity.

The system will adapt the search strategy based on the selected level of similarity chosen by the user, and also based on the nature of the trademark searched: number of letters, number of words, invented or existing word.

Mission

This module allows user to run a Figurative search on trademark databases using our proprietary Image-recognition Technology. This search doesn’t allow for any Vienna codes. The search will be purely based on the image (and classes/registers).

The search will be run independently from colors.

IA Industrial designs

Mission

This module allows users to run an Industrial Design search using our proprietary Image-recognition technology. This technology facilitates the pre-selection of relevant results among registered designs.

The search will be run across active and inactive registered designs.

Extremely important: the Image technology can be very sensitive especially for designs (3D). Therefore, it is critical to use images of the best possible quality, with a good contrast and no disruptive elements around the object to be searched.

User should preferably use drawing(s) and photograph(s).

User can upload several views of the same object (up to 7 views). These views should have an added value to the search.

This alert allows you to set up a monitoring on search results.
The system allows you to be informed, at the frequency of your choice (weekly, monthly etc) of any new search results matching your search criteria.
Ex: competition watch: launch a search on an owner and set up an alert to be informed of any new entry in our database by this owner.
Ex: product watch: launch a search on a specific product and set up an alert to be informed of any new entry in our database for this product.

This alert allows you to monitor any changes in a specific record:

The “Hit count” allows you to see how many results you get for each jurisdictions searched. We also display a hit count based on the Regions when, for example, you perform a Worldwide search.

Mission

The Folders allow users to save their searches in specific files/sub-files and therefore create their own tree structure of saved searches and records.

Specific records and searches can be saved in the Folders. Folders can be shared between users.

Build a search strategy

There are 3 levels of search strategies available. Move the slider to the appropriate level.

Identical phonetic will include any alphabetic and phonetic identical record in the searched and related classes.

Extended will include the same results as the identical phonetic search, and will also include a couple of additional algorithms (see search strategy for full details). This is an “in-between” search.

The Similarity level is the most comprehensive search available on the platform. The search strategy will include a much larger list of algorithms.

Clicking on the cogwheel next to the trademark searched will allow you to access the search strategy in details. The system is totally transparent in this regard.

The search strategy screen is divided into 2 sides.

  • On the left: the “Important words”, where the system defines the strong element(s) of the trademark to which the full algorithms (depending on the chosen strategy level) should be applied.
  • On the right: the “Words in a dictionary”, or “weaker elements”, to which a narrower search strategy is applied.

This strategy can be edited by the user. Don’t hesitate to contact us for assistance.

SELECT THE REGISTERS

Once you logged in to the platform and you have selected the most suitable module (Multi-criteria, Word similarity), the best way is to directly select the registers on which you want to perform the search.

Select the desired databases and then the registers/group of registers by ticking the corresponding boxes.

By ticking a national country that is part of the Madrid Agreement and Protocol, the system will automatically select the EUIPO/WIPO when applicable.

If you need to limit the results for the WIPO register designated the selected countries, please select the WIPO (limited to designated countries) box.

Trademarks and Pharmaceutical Databases, identified with this symbol , can be searched together in a single request.

Select the Trademark databases, then click on the Pharmaceutical option and select the databases. Click on OK to validate.

Identical Phonetic search

The system applies a very limited number of questions. The strategy on “Words in a dictionary” is also narrow:

Extended search

The system applies a number of questions larger than identical but less than similar (the “Phonetics” and “Alphabetic” questions are a bit more extended). We can see that the strategy on “Words in a dictionary” changed a bit:

Similarity

The system applies a very large number of questions (such as first and last characters in common) but also adds the “Phonetics” for the main/important terms. The strategy on “Words in a dictionary” is also wilder:

We search on both words individually and together (+ midfix on words) for “Words in a dictionary”.

Our system identifies the existing terms, applies fewer algorithms on these terms qualified as “weaker” in terms of weighting in the brand.

If needed, you can add more “Important words” and/or “Words in a dictionary” into the online search.
Just insert the words you want to add and then press Enter.

Related classes:
Any search run through the Word Similarity module (all 3 levels) will include an identical phonetic search in the related classes. The list of applicable related classes can be accessed by clicking on the cogwheel. See top right of the screen. The list of related classes can be changed by the user if needed.
