My Ordered Searches

Mission

Users can order offline searches from the Fovea IP team. Our analysts will run these searches for the users and deliver a search report which will be sent by email to the user(s) and will be available on their Fovea IP account for review.

Ordered searches can be reviewed on the Fovea IP platform with all the analysis and reporting functionalities available. The reports can be downloaded from the platform, can be shared across users and can also be shared externally with outside counsels, for example.

Mission

Fovea IP offers watching services across trademarks, company names, domain names and owner names. The watch reports are delivered to the users by email, and are also available on the Fovea IP platform in the Ordered Watches section.

The purpose of Fovea IP’s trademark watch service is to identify new trademark publications that are identical or similar to the trademark watched. Also, whenever a new watch is activated, we inform you of any past identical/similar publication for which the opposition deadline is still ongoing.

Multicriteria

Mission

Multicriteria is a module designed to manually search across the selected databases. There is no underlying automation or artificial intelligence, the users defines the search strategy to be applied.
The Multicriteria search module allows the user to search across more than 40 criteria: owner, representative, number, date, type of mark, etc.

  • Custom searches with wildcards and Boolean operators

Important:

A search on Trademark Name ROCK will allow you to retrieve trademarks ROCK or containing ROCK as a standalone word, such as ROCK THIS PARTY. It will not allow you to retrieve ROCKS or ROCKY or ROCKABILLY.

Word Similarity

Mission

This module allows users to run word mark searches with the help of an automated search strategy which is accessible to the user and editable by the user. Wildcard characters are not supported in this module.

This module is solely dedicated to availability searching. Other types of searches (owner, numbers, dates, etc) are not supported and have to be run through the Multicriteria module.

The Word Similarity module includes 3 levels of strategy: identical phonetic, extended and similarity.

The system will adapt the search strategy based on the selected level of similarity chosen by the user, and also based on the nature of the trademark searched: number of letters, number of words, invented or existing word.

IA Figurative

Mission

This module allows user to run a Figurative search on trademark databases using our proprietary Image-recognition Technology. This search doesn’t allow for any Vienna codes. The search will be purely based on the image (and classes/registers).

The search will be run independently from colors.

IA Industrial designs

Mission

This module allows users to run an Industrial Design search using our proprietary Image-recognition technology. This technology facilitates the pre-selection of relevant results among registered designs.

The search will be run across active and inactive registered designs.

Extremely important: the Image technology can be very sensitive especially for designs (3D). Therefore, it is critical to use images of the best possible quality, with a good contrast and no disruptive elements around the object to be searched.

User should preferably use drawing(s) and photograph(s).

User can upload several views of the same object (up to 7 views). These views should have an added value to the search.

This alert allows you to set up a monitoring on search results.
The system allows you to be informed, at the frequency of your choice (weekly, monthly etc) of any new search results matching your search criteria.
Ex: competition watch: launch a search on an owner and set up an alert to be informed of any new entry in our database by this owner.
Ex: product watch: launch a search on a specific product and set up an alert to be informed of any new entry in our database for this product.

Hit count

The “Hit count” allows you to see how many results you get for each jurisdictions searched. We also display a hit count based on the Regions when, for example, you perform a Worldwide search.

Mission

The Folders allow users to save their searches in specific files/sub-files and therefore create their own tree structure of saved searches and records.

Check your watch notices

WATCH NOTICES REVIEW

To review your watch notices, you have 3 options:

Click on the “3 dot” icon and then on “Load” to review the watch notices of this specific
Click on “Unread watch notices” to review all new watch notices for your entire portfolio.
Or click on “View all watch notices” to review all watch notices, read or unread, for your entire portfolio.

The unread notices are marked with an “eye”.
Previously “read” notices can be retrieved via the “All watch notices” area.

By default, watch notices will be sorted by opposition deadline – the shortest deadline being at the top of the list. The order can be changed by clicking on any column header (for example: sort by reference or watched name).

The column order can be customized for each user:

Reorganize your columns by clicking on the column header and dragging & dropping it wherever you see fit.
Add/delete columns by clicking on the Column button at the bottom right
– The new column order will be saved automatically.

To open a watch notice, click on the reported name.

AVAILABLE VIEWS

You will then have access to 3 or 4 different views:

– “Watch view” (this is your watch notice). The document generated for the watch notice is static information. If you have provided with the Trademark application/registration number, the details of the trademark watched will be also displayed.
– “Detailed view” (full copy of the reported mark). Dynamic view: the full details of the found trademark is up to date.
– “Identical trademark(s) previously notified” which automatically detect if we already sent you the same trademark(s). The system retrieves the “read/unread watch notices” for you.
“Prior rights (same classes)”: Instantly find the defendant’s prior rights while considering opposition (Does this owner have other identical trademarks?).


WIPO DESIGNATED COUNTRIES OPPOSITION DEADLINE

If you want to receive watch notification for WIPO designated countries when the trademark is published nationally, you need to activate the “national publication” button available on the full view of the found trademark.

 

You will be notified once a trademark is nationally published ONLY if the national register is covered by the watch itself.
For some registers, the national opposition deadline is calculated based on the WIPO publication, so the dates are already available on the watch notices (see below in orange):



PRIOR RIGHTS

The Prior Rights Search provides any potential Opposer with all the information needed regarding the rights that the potential Defendant owns that could be used for a counterattack against any rights owned by the potential Opposer.
The Prior Rights Search reports all existing applications/registrations filed or registered by the (potential) Defendant:

»    In the (potential) Defendant’s home country, or
»    In the opposition jurisdiction, and
»    Worldwide, for any mark that is identical to the mark to be opposed
»    Reports also rights of the owner of the watched trademark in the jurisdiction of the (potential) dispute. In order to allow you to remain consistent in the notifications to your clients, we have set up a system that automatically finds the “Identical trademark(s) Previously Notified” symbolized by this icon :

By clicking on this icon, you will have an overview of the number of identical trademarks that have already been notified and you will also be able to view any comments and risk levels previously indicated.

OPPOSE?

Get instant insights on how and potentially with whom to file an opposition in any jurisdiction! We provide you with the details of what you need to know to file an opposition in any jurisdiction as well as a list of local agents and their details you can contact. Our aim again is to save you time collecting that information. This is where our role ends. We don’t intervene whatsoever in your interactions with any of those local agents. KEYWORDS FILTERING

From the column Keyword, clicking on    will display the list of all keywords triggered by the watches. You have the possibility to deselect irrelevant keywords or isolate them in order to mark them as “Read”. The keywords can be displayed as a list or as a cloud.

Rolling over a keyword with your mouse will display the number of watch notices sent since the beginning of the watch.

EXCLUDE KEYWORDS

This is a unique feature offered by Fovea IP. You have the possibility to exclude any irrelevant keyword, so this keyword is excluded from your future watch notices. This feature allows you to refine your watch results over time. The more you use this feature, the more relevant you watch results will be!
You will no longer receive watch notices generated by those keywords in the future.

What is a keyword?

The keyword is the word within the reported trademark that triggered the watch notice because of its similarity with the watched mark. Here are some examples:

If you believe that the trademark found is irrelevant, you can click on the keyword to exclude it from future results.

Please keep in mind that you will not exclude the trademark, but the keyword, so this means that any trademark containing this keyword will not be reported anymore in the future, unless there are other similar elements in the trademark.

Example:

The Keyword here is BLUES.

You can easily choose another view by clicking on one of the views available at the bottom of your screen:
